Just
as the Jury in a closely watched tempnapping case was about to deliver its
verdict, a new book on tempnapping was released - and has hit the shelves of
many temporary help firms. Tempnapping Saga and Solution: A Guide to Protecting Your Company by
A. Bernard Frechtman offers a complete guide to tempnapping - its history, key
cases, and suggestions for protecting your firm.
The first half of the 217-page volume describes,
warns, and teaches readers about the intricacies of tempnapping. In the chapter “The Saga,” Frechtman outlines the history
of tempnapping - including applicant fee-paid business, permanent placement
agencies, and temp-to-perm practices - to explain how this phenomenon surfaced
and is now practiced. In “The
Solution,” he suggests what to do in situations which temps could be napped,
discusses temp and client contracts and pre-employment agreements, and describes
the operational differences between liquidated damages and conversion fees.
The “Conversion Fee Cases” chapter describes
specific court cases and discusses at length suing for the conversion fee,
language to use on time sheets, group time sheets, and other contingencies.
Although the book is the product of a substantial
legal background, it is written for the non-legal reader. For example, Chapter 4, which addresses “Disintermediation
(Eliminating the Middleman),” starts with the admonition that, if the lay
reader finds it a bit difficult, he or she should not “worry about it and if
necessary just pass by, remembering only that the significance of the case is
that you should have your temporary employees sign a restrictive covenant for a
reasonable period of time after the assignment terminates.”
The book is sprinkled throughout with practical, understandable advice
such as this that clarifies and expands on its key concept.
In the second half of the book, appendices
provide articles written about tempnapping, court opinions from four tempnapping
cases, and sample documents intended to provide protection against tempnapping.
The first-ever treatise on tempnapping is
thorough, complete, and a practical hands-on guide for independent temporary
help firms on what tempnapping is and how to deal with it by protecting yourself
and securing compensation. Although
a bit pricey at $147 (plus $8 postage and handling), this book is a must-have
for temporary help firms looking to secure a thorough how-to-book of tempnapping
and how to deal with it.
